| 1) Your contract |
a) Your holiday arrangements are booked through Totally Travel Limited trading as Go Now Cruise. Our registered office is at Abbey House, 56 Burleys Way, Leicester, LE1 3BD and our company number is 808547608. We are retail members of ABTA, membership number K4354. We act as a booking agent for Cruise lines/Tour Operators.
b) Your contract is with the suppliers of the services, the Cruise lines/Tour Operators. Cruise Lines are members of the Passengers Shipping Association. As we are acting as agents for these suppliers, we accept no liability for any failure in the services or any loss of any nature suffered by you as a consequence of using the services. Nothing on our website and/or any quotation given by us to you on the website or otherwise shall constitute an offer by us to sell or supply goods or services and we reserve the right in our absolute discretion to refuse to accept any booking from you. We do not assume any responsibility for the travel products and services provided by the Third Party Supplier and make no representations or warranties (express or implied) about the suitability or quality of travel products and services featured on our website.
c) When you make a booking you confirm that you have the authority to accept and do accept on behalf of your party the terms and conditions set out below. A booking can only be made by a person aged 18 years or over. |

| 2) Cruise Line/ Tour Operator Conditions and Fair Trading Terms |
a) Please note that all bookings are subject to the Cruise Line's conditions of booking. These contain limitations and exclusions of liability to any person who travels with the Cruise Line. They should be read carefully as you are bound by them. We will ask you to sign a booking form confirming your agreement to these terms.
b) The accommodation and amenities are as described in the Cruise Line's brochure and therefore any changes made by the Cruise Line are subject to their booking conditions.
c) The Cruise Line reserves the right to change itineraries and holiday details, the flight timings are provisional and could be subject to change. You will be informed of any major change.
d) All costings are subject to final confirmation as appearing on the Cruise Line's invoice, errors and omissions are excepted. Children's discounts are subject to the correct age of the child being given as at the last date of the holiday.
On this Website we can not contain all information relevant to the Cruise Line's holiday or travel arrangements so it is important that you read the Cruise Line's current brochure. |

| 3) Making your payment |
a) You may make it in one of the following ways: Delta or Switch; credit card (Visa or MasterCard); cheque or postal order.
No charge is made for payment by Switch or Delta debit cards, however credit card payments will incur a 2% surcharge. Cheques should be made payable to Totally Travel Ltd.
We need your payment to be made in pounds sterling.
You will need to pay a deposit at the time of booking and the balance paid 12 weeks prior to departure. If your departure date is within 12 weeks of departure you will need to make full payment plus £10.00 per person late booking fee at the time of booking, less any discount. All holidays are subject to availability at the time the booking is made. |

| 4) Financial Protection |
a) The air holidays and flights shown are ATOL Protected by the Civil Aviation Authority, and we act as agents for licensed tour operators.
The flight bookings we make are also ATOL Protected, except where tickets for scheduled flights are sent to you within 24 hours of payment being accepted, or where your payment is made direct to airlines.
ATOL Protection extends primarily to customers who book and pay in the United Kingdom. |

| 5) Discounts |
a) Discounts available through this website are based on the Cruise Line's basic cost and are refundable to Go Now Cruise on cancellation. The discount is only valid provided payment is made by the due date and travel actually takes place. Discounts will only apply to bookings made at least ten weeks prior to departure.
b) The total basic holiday price is the brochure price after any special reduction given by the Cruise Lines, excluding port taxes, surcharges, gratuities where it is not stated that they are included in the basic holiday price, supplements, insurance, car hire, amendment and cancellation charges and special excursions.
c) Prices shown are based on 2 adults sharing accommodation. |

| 6) Special Offers |
a) All information for the Late Offers advertised are supplied by the Cruise Lines to Go Now Cruise. It is given in good faith and we cannot be responsible for any errors in the information supplied by the Cruise Lines or for any subsequent changes or alterations made by the Cruise Lines.
b) The cruise offers are supplied by the Cruise Lines to Go Now Cruise at frequent intervals and are then updated onto the pages of this Website. Every effort is made to display current data, however, availability is constantly changing and we cannot guarantee the availability of Cruise Line's holidays. We must point out therefore that all holidays are subject to availability at the time of booking.
c) Prices shown are based on 2 adults sharing accommodation. |

| 7) Prices and website accuracy |
a) Every effort is made to provide as much information as possible on this website and to ensure this information is accurate. Regrettably however changes and errors do occasionally occur. We cannot accept liability for errors on this website.

| 8) Special Requests |
| a) Special Requests such as assigned seat number requests, special meal requests etc will be passed on to the relevant supplier but cannot be guaranteed by Go Now Cruise. |

| 9) Holiday Insurance |
a) It is a condition of booking with every Cruise Line or Tour Operator that passengers must have adequate travel insurance at the time of booking, this means that you are properly covered against unexpected cancellation charges prior to departure and events occurring during your holiday.
b) Go Now Cruise currently offer a quality policy with Preferential Insurance Services Limited. This high quality holiday and travel insurance will ensure you have complete peace of mind both before you travel and whilst you are on holiday. The Preferential Elite Policy is competitively priced and can offer the following example rates: for a 16 night holiday in Europe £34.95 per person, and Worldwide £62.45. These premiums are subject to change without notice. If you require, Insurance details are available on request.
c) If you require a copy of our policy, tailored to suit your needs, please ask one of the consultants and they will send one out to you.
d) Please be aware that all insurance policies contain exclusions and it is essential prior to purchasing any policy to bring any pre-existing medical conditions to the attention of the insurers. |

| 10) Your Tickets |
| a) Tickets and travel documents are normally supplied 7 to 10 days prior to departure. If you do not receive your tickets 7 days before departure please contact us using the contact details provided below. Please check your travel documents carefully upon receipt, and advise us immediately of any error. |

| 11) Passports, Visas and Health |
a) Please note all general information relating to your destination from the Cruise Line's brochure. In particular, please note the Passport, Visa and Health requirements for your destination. When you travel with the carrier, the carrier's conditions apply. We do not accept any responsibility if you do not comply with the regulations.
b) Passports
The following applies to British Citizens holding a British passport travelling for tourist purposes from the UK:
You will need a full 10 year passport to travel on all holidays except those in the UK. In order to comply with regulations imparted by certain countries your passport must be valid for at least 6 months after the date of your return. If your passport expires earlier than this it may still be acceptable but you should contact your local passport office or the Consulate or Embassy of country to be visited for detailed advice.
If you do not already have a passport, or your passport is about to expire please enquire at your main Post Office or nearest Passport Office at least eight weeks before departure. If your child does not have a passport, or it's not already included on a valid passport, he or she now require their own passport. You will need to ask at your Passport Office for full details. We strongly advise that you contact your local Passport office or the Consulate or Embassy of the country you will be visiting for detailed advice. Other passport holders should check with the Consulate or Embassy of the country you will be visiting for further information.
c) Visas
You may require a visa for your holiday.
For British Citizens holding a British Passport, information on visas will be detailed in your Cruise Line's brochure and is also available from the relevant Embassy.
We will be pleased to assist with any queries you have, but please note that information given by us or the Cruise Lines may become out of date so we advise that you check with the relevant Embassy in good time. Countries may alter their visa requirements without notice, and we recommend that you consult the embassy of the country you are visiting.
d) Health
Travel to certain countries may mean that it is advisable or compulsory for you to be inoculated against certain illnesses. In view of the fact that the information is constantly changing we cannot guarantee to give you up-to-date information. We suggest you read the Department of Health leaflet which can be obtained by phoning 0800 555 777 and contact your GP, or local health authority. Remember if you have any queries our Sales Consultants will be happy to advise you, and in addition we will send you full details of useful contacts, addresses and telephone numbers with your confirmation details. Please note though that it is your responsibility to obtain the relevant documentation and inoculations required, and not the responsibility of Totally Travel Ltd or the Cruise Line or Tour Operator.

| 12) If you cancel your holiday |
a) Once your holiday has been booked it can be cancelled subject to payment of a cancellation charge. In the event that you cancel the holiday, the Cruise Line will issue a cancellation invoice detailing the cancellation charges applicable.
If your holiday has been discounted, the discounts will not apply to these cancellation charges and if you have paid your full balance for the holiday the discount is refundable to Go Now Cruise.
b) All cancellations must be made in writing by the lead name in your party to:

c) In the event of cancellation, any charges may be recovered by your travel insurance. Please check your insurance policy for more information. If the cancellation is covered by your travel insurance this will be based on the Cruise Line's cancellation charges. |

| 13) Alterations to your booking by the Cruise line/Tour Operator |
| a) Unfortunately we cannot control or prevent changes implemented by our suppliers. Should a change occur we will endeavour to minimise the inconvenience you may experience. We cannot however offer any compensation. Again, please refer to the booking conditions of your Cruise Line/Tour Operator. |

| 14) If you have a complaint |
a) Some disputes involving claims up to a limited amount may, if the passenger so wishes, be referred to Arbitration under schemes devised by the Chartered Institute of Arbitrators for the Passenger Shipping Association and ABTA. An application for Arbitration must be made within nine months of disembarkation from the cruise ship. In addition the Passenger Shipping Association offers a low cost Conciliation procedure, where a non-binding review of correspondence is undertaken by an independent Conciliator. Details of these schemes are available on request. We will be pleased to assist you with any queries you have in connection with the booking.

| 16) Data Protection |
a) For the purposes of the Data Protection Act 1998 we, Go Now Cruise Limited, are a data controller. In order to process your booking need to collect certain personal details from you. These will include, where applicable, the names and addresses of party's members, credit/debit card or other payment details and special requirements such as those relating to any disability or medical condition which may affect the chosen booking and any dietary restrictions which may disclose your religious beliefs. If we need any other personal details, we will tell you before we obtain them from you. In order to process your order we will share your information with the cruise line, tour operator, airline, hotel, car rental agency, or other involved third party or supplier. We will provide only the personally identifiable information necessary to ensure the successful fulfillment of your travel arrangements. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law.
b) We have appropriate security measures in place to protect the personal details you give us. Where your travel arrangements are to take place outside the European Economic Area, (EEA), controls on data protection in your destination may not be as strong as the legal requirements in this country. We will not however, pass any information on to any company and/or organisation not responsible for providing any part of your travel arrangements. Where you provide us with personal details relating to any special requirements and/or details of any illnesses, disabilities or religious requirements, you consent to this information being passed onto any organisation or companies responsible for any part of your travel arrangements whether in the EEA or not. If we cannot pass this information to the relevant suppliers, we cannot process your booking.
c) We are entitled to assume you do not object to our doing any of the things mentioned above unless you tell us otherwise in writing. You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee to respond to such a request. In limited circumstances we are entitled to refuse your request. Except where expressly permitted by the Data Protection Act 1988, we will only deal with the personal details you give us as set out above unless you agree otherwise. For example, if we wish to use any of your personal details for marketing purposes, we will tell you this when we ask for your details and give you the opportunity to say no if you do not want us to do so. |
